By creating an account, connecting an integration, uploading content, purchasing a subscription, or using our services, you agree to these Terms and our Privacy Policy. If you use the service on behalf of a company, client, podcast, or other organization, you represent that you have authority to bind that organization.
Evolved Podcast Academy provides podcast hosting, podcast setup/import support, content repurposing tools, and related services. Features may include:
Features may change over time. Some features may require an active subscription, available usage allowance, or a connected third-party account.
You are responsible for:
You retain ownership of podcast files, audio, video, images, transcripts, brand assets, edits, and other content you submit to the service.
You grant Evolved Podcast Academy a limited license to host, store, copy, process, transcribe, transform, generate, display, transmit, and otherwise use your content only as needed to provide, secure, support, and improve the services you request.
You represent that:
The service may use automated processing and AI-assisted tools to create transcripts, titles, posts, images, captions, clips, and other outputs. Generated content may be inaccurate, incomplete, offensive, unsuitable, or inconsistent with your brand or legal obligations.
You are responsible for reviewing and approving generated content before using, saving, publishing, downloading, or distributing it. We do not guarantee that generated content will be error-free, original, non-infringing, compliant with platform rules, or effective for audience growth.
You may connect third-party accounts to enable import, save, publishing, distribution, or account-status features. By connecting an integration, you authorize us to use that connection to perform actions you request or enable in the service.
You are responsible for complying with each third-party platform's terms, policies, community standards, advertising rules, API rules, and content requirements. We are not responsible for third-party platform outages, review decisions, account restrictions, takedowns, demonetization, API changes, permission changes, or data controlled by those platforms.
You may disconnect integrations from the Connections page where supported. Disconnecting stops new actions through that connection but may not delete content already imported, saved, or published.
If you connect Google Drive, you authorize us to access Google Drive as needed to let you select and import files and save approved generated content to your Drive. If you connect YouTube, you authorize us to verify the connection and upload approved video content when you request it.
You are responsible for ensuring that any files imported from Google Drive and any videos uploaded to YouTube comply with applicable laws, these Terms, and YouTube's terms and policies.
Paid features may require a subscription or other paid plan. Prices, plan features, upload limits, transcription limits, clip limits, connection limits, and other usage allowances may vary by plan and may change over time.
Payments and billing management are handled through our payment provider. By purchasing a subscription, you authorize recurring charges according to the plan selected. You are responsible for keeping billing information current.
If payment fails or a subscription is cancelled, expires, or becomes inactive, we may restrict, suspend, or downgrade access to paid features. Cancellation terms and refund eligibility are described in our Refund Policy unless a separate written agreement applies.
Files must be submitted through approved upload, import, or connection methods. Processing times vary based on file size, episode length, system load, subscription tier, third-party services, and content complexity.
We may reject, remove, suspend processing of, or refuse to publish content that violates these Terms, appears unlawful, creates security or operational risk, infringes rights, violates third-party platform rules, or may expose us or others to liability.
You may not use the service to:
We treat submitted podcast files, generated content, and connected-account information as confidential business content and do not disclose it except as needed to provide the service, follow your instructions, use service providers, comply with law, protect rights and safety, or as described in the Privacy Policy.
We aim to provide reliable service, but we do not guarantee uninterrupted or error-free operation. Features may depend on third-party APIs, cloud providers, AI providers, payment providers, and social platforms. We may modify, suspend, discontinue, or limit features at any time.
Evolved Podcast Academy and its software, design, workflows, templates, branding, documentation, and service materials are owned by us or our licensors. These Terms do not transfer ownership of our intellectual property to you.
Unless otherwise agreed, you may use outputs generated for your account for your podcast, business, client work, and related marketing, subject to your responsibility for review, rights clearance, and compliance with law and platform rules.
If you provide feedback, suggestions, or ideas, you grant us permission to use them without restriction or compensation.
You may stop using the service at any time. We may suspend or terminate access if you violate these Terms, fail to pay, create risk to the service or others, misuse integrations, submit prohibited content, or if required by law or third-party platform requirements.
Termination may not automatically delete content already published to third-party platforms. You are responsible for managing published content on those platforms.
The service is provided on an "as is" and "as available" basis. We disclaim warranties to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and results.
We do not guarantee audience growth, monetization, ranking, engagement, revenue, publishing success, platform acceptance, or specific business outcomes.
To the maximum extent permitted by law, Evolved Podcast Academy is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, loss of data, loss of goodwill, platform restrictions, publishing failures, or content performance.
Our total liability for claims relating to the service is limited to the amount you paid to us for the service giving rise to the claim during the three months before the event giving rise to liability.
You agree to indemnify and hold harmless Evolved Podcast Academy from claims, damages, losses, liabilities, costs, and expenses arising from your content, your use of the service, your connected accounts, your published content, your violation of these Terms, or your violation of law or third-party rights.
We may update these Terms from time to time. If we make material changes, we will update the date above and may provide additional notice where required. Continued use of the service after an update means you accept the revised Terms.
